Washington Consumer Health Data Privacy Policy

This Washington Consumer Health Data Privacy Policy applies to consumer health data that Wanderkeep Travel Group LLC ("Wanderkeep," "we," "us," or "our") collects from or about Washington consumers and is subject to Washington's My Health My Data Act. "Consumer health data" means personal information that identifies or is reasonably linkable to a Washington consumer and identifies the consumer's past, present, or future physical or mental health status, as defined by applicable law.
1. Categories of Consumer Health Data We Collect and How We Use It
Depending on the travel services requested and the information voluntarily provided to us, Wanderkeep may collect the following categories of consumer health data:

Physical or mental health conditions, symptoms, diagnoses, medical needs, or relevant medical history that a traveler chooses to disclose;

Disability, mobility, accessibility, or accommodation needs, including requests for accessible rooms, mobility equipment, boarding assistance, seating, or other assistance;

Allergies, food sensitivities, and dietary restrictions when the information identifies or may be associated with a health condition;

Medication information that a traveler chooses to provide when relevant to requested arrangements or assistance;
-
Vaccination, testing, or health-document information required by a destination, government authority, travel supplier, or requested service;
-
Travel-insurance, medical-assistance, or health-coverage information relevant to arranging or administering requested travel services; and
-
Other information that identifies or may reasonably be associated with a consumer's physical or mental health status and is provided in connection with requested travel services.
We collect and use these categories of consumer health data to provide travel products or services requested by the consumer; arrange and communicate accessibility, mobility, dietary, allergy, medical, insurance, emergency-assistance, or other special-service requests; communicate with travel suppliers and service providers involved in the requested trip; respond to trip-related emergencies or safety concerns; maintain records of requested arrangements; and comply with legal, regulatory, supplier, insurance, or contractual requirements applicable to the requested services.
2. Categories of Sources
We may collect consumer health data from:

The consumer directly, including through forms, email, telephone, messages, or other communications;

A parent, legal guardian, family member, travel companion, group organizer, authorized representative, or other person authorized to arrange services for the consumer;

Independent travel advisors affiliated with Wanderkeep who receive the information in connection with requested services;

Travel suppliers, travel-insurance providers, emergency-assistance providers, or other service providers involved in the consumer's requested travel; and
-
Records and communications generated while arranging, administering, changing, or supporting the requested travel services.
3. Categories of Consumer Health Data We Share
When necessary to provide a product or service requested by the consumer, or when the consumer has provided any consent required by law, we may share the categories of consumer health data listed in Section 1. The particular information shared depends on the service requested. For example, an accessibility request may require sharing mobility or accommodation information, while an allergy-related request may require sharing relevant allergy or dietary information.
4. Categories of Third Parties and Specific Affiliates
We may share consumer health data with the following categories of third parties when necessary to provide a requested travel product or service, when directed or authorized by the consumer, or as otherwise permitted by law:

Airlines, cruise lines, hotels, resorts, tour operators, destination-management companies, transportation providers, venues, activity providers, restaurants, and other travel suppliers involved in the requested travel;

Travel-insurance companies, emergency-assistance providers, and other providers involved in requested insurance, medical-assistance, accessibility, or safety services;

Government authorities, regulators, law-enforcement agencies, courts, legal counsel, insurers, or other appropriate recipients when disclosure is required or permitted by law or reasonably necessary to protect a consumer or another person; and
-
Other third parties identified by or authorized by the consumer.
Wanderkeep does not currently share consumer health data with any corporate affiliate. Independent travel advisors affiliated with Wanderkeep are contractors or service providers, not corporate affiliates.
5. Consent, Additional Uses, and Sale
Wanderkeep collects and shares consumer health data only to the extent necessary to provide a product or service requested by the consumer or with consent as required by law. We will not collect, use, or share additional categories of consumer health data, or use consumer health data for additional purposes not disclosed in this Policy, without first providing any disclosure and obtaining any affirmative consent required by law. Wanderkeep does not sell consumer health data.
6. Washington Consumer Rights and How to Exercise Them
Subject to applicable law, a Washington consumer has the right to:

Confirm whether Wanderkeep is collecting, sharing, or selling consumer health data concerning the consumer and access that data, including a list of third parties and affiliates with whom the data has been shared or sold and available contact information for those recipients;

Withdraw consent from future collection or sharing of consumer health data;

Request deletion of consumer health data, including notification of the request to affiliates, processors, contractors, and other recipients as required by law; and
-
Appeal Wanderkeep's refusal to act on a request.
To exercise a right, email privacy@wanderkeep.com. Please state that the request concerns Washington consumer health data and provide information reasonably sufficient for us to authenticate the request and locate the relevant records. You are not required to create a new account to submit a request.
We will respond without undue delay and ordinarily within 45 days after receiving a request. When reasonably necessary, we may extend the response period once by an additional 45 days and will provide notice of the extension and the reason for it. If consumer health data requested for deletion is stored in archived or backup systems, deletion from those systems may be delayed as permitted by law, but not longer than six months after authentication of the request. Information is generally provided free of charge up to twice annually, subject to applicable law concerning manifestly unfounded, excessive, or repetitive requests.
If we deny a request, you may appeal by emailing privacy@wanderkeep.com with "Washington Health Data Appeal" in the subject line and explaining the basis of the appeal. We will respond to the appeal in writing within the period required by law. If an appeal is denied, we will provide information about how to submit a complaint to the Washington State Attorney General. We will not unlawfully discriminate against a consumer for exercising a right under the My Health My Data Act.
